Changes take effect in October 2023
Societies already incorporated as a trust board
If you're a society that's already incorporated as a trust board, you will have the option of converting into an incorporated society. This is optional but may be a good option for organisations that prefer the detailed rules of the Incorporated Societies Act 2022 over the sparse rules set out in the Charitable Trusts Act 1957.
Unincorporated societies won't be able to incorporate as a board
From October 2023, unincorporated societies will no longer have the option of incorporating under the Charitable Trusts Act 1957. They will need to incorporate as incorporated societies under the Incorporated Societies Act 2022.
Trustees incorporating as a board will not be affected
A board made up of trustees is not affected by these law changes in any way. Unincorporated groups of trustees will continue to be able to incorporate as a board under the Charitable Trusts Act 1957.
